1. Who we are

These terms apply to every order placed through this website. The version published at the time of your order applies to that order; later changes never apply retroactively.

2. How we work

We operate as a dropshipping store. Our products are shipped directly to you by our fulfilment partner in Ningbo, China. This means delivery takes longer than from a local warehouse: orders are processed within 1 to 3 business days and transit takes 8 to 10 business days, so you receive your order at the latest within 13 business days. Returns are sent to our fulfilment partner's warehouse in China; see our Return, Withdrawal & Refund Policy for details and estimated return costs.

3. Prices

All prices shown include VAT. The price you see at checkout, plus any displayed shipping cost, is the total price you pay: you will not be charged additional customs or import fees on delivery. Shipping costs, if any, are shown before you complete your order. If a price contains an obvious error, we will contact you before processing; you may then confirm at the correct price or cancel free of charge.

Where we show a discount against a crossed-out price, the crossed-out price is the lowest price we applied in the 30 days before the start of the promotion.

4. Your order and the contract

Your order is placed when you confirm it at checkout; this is a binding order with an obligation to pay. The contract is concluded when we send you the order confirmation by email. We may decline an order for legitimate reasons, for example suspected fraud or an address we cannot deliver to; in that case you will be informed and any payment refunded in full.

You can ask us to correct or cancel your order free of charge at any time before dispatch by contacting us.

5. Delivery

We deliver at the latest within 13 business days after your order confirmation, and in any event within 30 days as required by law. If we cannot deliver on time, we will inform you and you may set an additional reasonable period; if we still fail to deliver, you may cancel the order and receive a full refund without delay. The risk of loss or damage passes to you when you (or someone you designate) physically receive the goods. If your parcel is lost in transit, we will resend it or refund you in full.

6. Right of withdrawal

Under UK and EU consumer law, you have the legal right to withdraw from your purchase within 14 days of receiving your order, without giving any reason. We voluntarily extend this to 30 days. The full conditions, the model withdrawal form, the return address in China and the estimated return costs are set out in our Return, Withdrawal & Refund Policy, which forms part of these terms.

7. Legal guarantee

All our products are covered by the legal guarantee of conformity of 2 years. If a product is defective, does not match its description, or you received the wrong item, you are entitled to repair or replacement, or where applicable a price reduction or full refund, at our expense, including all return shipping costs. This legal guarantee applies independently of, and is not limited by, any manufacturer's warranty. Contact us with your order number and photos of the issue and we will resolve it.

8. Product information

We take care that product descriptions, materials, sizing and images are accurate. Minor colour differences can occur due to screen settings; this never affects your right of withdrawal or your legal guarantee if the product does not conform to what you ordered.

9. Payment

We accept the payment methods shown at checkout. Payment is processed securely by our payment providers; we never store your full card details. No additional service is ever added to your order without your express consent.

10. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, for intentional fault or gross negligence, or for your statutory rights as a consumer, including the legal guarantee and the right of withdrawal. Subject to that, we are liable in accordance with Belgian law.

11. Intellectual property

The content of this website (texts, images, logos, design) is protected by intellectual property rights. You may not reproduce or commercially exploit it without our permission.

12. Complaints and disputes

If you have a complaint, contact us first at support@york-fashion.com and we will do our best to resolve it within 7 business days. If we cannot resolve it together, you can turn to the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur, North Gate II, Boulevard du Roi Albert II 8, 1000 Brussels, www.mediationconsommateur.be) or the alternative dispute resolution body in your country of residence.

13. Governing law

These terms are governed by Belgian law. If you are a consumer residing in the United Kingdom or in an EU country, you always keep the protection of the mandatory consumer law provisions of your country of residence. Disputes may be brought before the competent court under applicable law.

14. Severability

If any provision of these terms is found invalid, the remaining provisions remain in force. The invalid provision will be replaced by a valid one that comes closest to its intent, within the limits of the law.
